Terms And Conditions
SCOPE OF WORK While WireNut Home Services (“WireNut” or “we” or “our”) strives for minimal to no damage to the work areas, our work does periodically result in unforeseen damages or losses. Unless specifically purchased as a foreseen necessity for the scope of work, our work does not include repairs to any surfaces, interior walls, floor surfaces, exterior walls, landscaping areas, or concealed areas. If drain clearing machinery, liner machinery, material, or other WireNut property becomes lodged or lost in the home or any other related location, the homeowner is responsible for related costs.
OPTIONS FOR REPAIR We strive to present repair options where safety violations or upgrades are discovered. Failure to correct these items resulting from the refusal of services may result in further damages and will void all warranties. In such case, the customer will be solely responsible for all damages. All work performed will be performed in compliance with the latest building code(s).
DIAGNOSTICS All diagnostics include and are limited to investigation of one individual issue. This diagnostic will identify problems within the system, thus enabling us to propose any needed solutions options, including but not limited to additional repairs or replacements.
REQUIRED DEPOSITS; PAYMENTS REQUIRED AT TIME OF SERVICE; UNPAID INVOICE FEES All work performed requires a deposit of not less than 50% of the anticipated project costs and fees. All task codes that have been commenced, as well as 15% of the remaining balance above and beyond such codes, will remain non-refundable. If agreed upon in advance, retainage amounts not to exceed 10% of the gross amount of any project costs and fees may be withheld until completion of inspection of the applicable phase of work. Payment in full will be due upon completion of each phase of work. Incomplete building department inspections or any third-party roles are not justification for delayed payments, these all fall under warranty obligation. Failure to receive third-party financing does not relieve the customer of the obligation to pay the amounts in full. Unpaid balances will be subject to an uncollected invoice fee of $40, as well as a service charge of 2% per month on the entire unpaid balance, including improperly unreleased retainage amounts. Customer further agrees to reimburse any and all collection and attorney fees in the process of collecting unpaid balances. Unpaid balances outstanding for more than 30 days may result in a mechanic’s lien filed against the property where services were rendered.
ALL WARRANTY & GUARANTEE TERMS Warranties and guarantees only become valid upon payment in full of the related invoice; any refund or adjustment will void all warranties and guarantees.
LIFETIME WORKMANSHIP GUARANTEE WireNut offers our Exclusive Lifetime Workmanship Guarantee to the original purchaser of residential services on specific work where those services have not been tampered with by another party. This guarantee is defined as the proper installation based on local building codes at the time of installation and is specifically listed on any work tasks where it applies. This guarantee specifically excludes code upgrades, parts or equipment failures.
WARRANTY & REBATES Work performed may include warranties specifically listed on the invoice. In the event of warrantied product failure, there will be no charge for a return visit during normal operating hours (8am-4pm, M-F). In the event of an extended manufacturer warranty, that warranty will apply as a credit to your account which may be redeemed dollar for dollar towards your repair work. All extended warranties must be in writing to be applicable. Warranty Exclusions: Customer-supplied parts, expendable/consumable items, pre-existing conditions of the home, or for any tampering with work other than WireNut personnel. WireNut shall not be liable for any damage due to acts of God or nature, manufacturer warranty/registration or third-party rebates.
DISPUTE RESOLUTION All disputes between the parties shall be resolved through the process of mediation, and if no settlement or agreement is reached, through the process of arbitration, under and through the rules of the Judicial Arbiter Group, Inc., located in Colorado Springs, Colorado. Any such mediation and arbitrations shall be held in El Paso County, Colorado.
BUILDING PERMITS & INSPECTIONS All work involving permits must be completed within 6 months as determined by the bldg. dept. Any delays or appointments missed by customer, leading to additional building dept fees will result in additional charges to customer or location owner. All charges due back to WireNut will be subject to the above-noted payment terms.
